Dolores GONZALEZ, Appellant v. DISCOVER BANK, Appellee
From the 49th Judicial District Court, Webb County, Texas Trial Court No. 2023CVH000968D1 Honorable Jose A. Lopez, Judge Presiding.
ORDER
Beth Watkins, Justice.
The reporter's record is currently due July 8, 2024. On June 24, 2024, the court reporter filed a notification of late record, stating that the reporter's record has not been filed because appellant has failed to request the record in writing. The notification further states that the appellant has not paid the court reporter's fee to prepare the record and is not entitled to appeal without paying the fee.
We ORDER appellant to provide written proof to this court by July 8, 2024 that she has asked the court reporter in writing to prepare the reporter's record, which request must designate the portions of the proceedings and the exhibits to be included. See Tex. R. App. P. 34.6(b)(1).
Appellant has filed a Statement of Inability to Afford Payment of Court Costs or an Appeal Bond in this court. If the court reporter wishes to file an objection to appellant's claim of inability to pay, she must do so by filing a written objection in this court by July 8, 2024. If the court reporter does not file a written objection in this court, we will assume she has abandoned any objection to the appellant's claim of inability to pay, and the reporter's record will be due 30 days after appellant files written proof that she requested the record in accordance with Texas Rule of Appellate Procedure 34.6(b).
If appellant fails to request the record in writing, appellant's brief will be due within thirty days of the date of this order, and the court will consider only those issues or points raised in appellant's brief that do not require a reporter's record for a decision. See Tex. R. App. P. 37.3(c).
