This case was called from the calendar of the Court's Milwaukee, Wisconsin trial session on June 12, 2023, for hearing on respondent's Motion to Dismiss for Lack of Prosecution, filed May 22, 2023. Petitioner notified the Court and counsel for respondent the morning of calendar call that she was sick and unable to attend the proceeding. Counsel for respondent appeared and was heard. The Court held a conference call with the parties the same afternoon. On June 14, 2023, we directed petitioner to show cause in writing by July 12, 2023, why the Court should not grant respondent's May 22, 2023, Motion to Dismiss for Lack of Prosecution.
On July 12, 2023, petitioner informally responded to our Order to Show Cause. She explained why she was unable to attend trial and provided medical documentation. The Court is satisfied that our Order to Show Cause should be discharged. Upon due consideration and for cause, it is hereby
ORDERED that the Order to Show Cause, filed June 14, 2023, is discharged.
The parties are reminded that respondent's Motion to Dismiss for Lack of Prosecution, filed May 22, 2023, remains pending before the Court.
