This cause is before the Court on appellant's sixth motion for extension of time to file appellant's brief. Appellant's brief was originally due to be filed on June 9, 2023. On October 12, 2023, appellant's counsel was ordered to file appellant's brief on or before November 13, 2023. In an Order issued on December 4, 2023, after appellant had difficulty obtaining portions of the record, appellant was provided thirty additional days to file a brief making appellant's brief due on or before January 3, 2024. Finally, in an Order issued on January 24, 2024, appellant was provided additional time to file a brief making appellant's brief due on or before February 2, 2024. Appellant has now failed to timely file a brief and has requested further extension of time to do so.
The Court, having fully examined and considered the timeline and appellant's failure to file a brief in this cause, is of the opinion that, in the interest of justice, appellant's motions for extension of time to file the brief should be granted with order. The Court looks with disfavor upon appellant's current counsel's failure to timely file appellant's brief.
Accordingly, appellant's sixth motion for extension of time to file the brief is hereby granted. IT IS THEREFORE ORDERED that the Honorable Victoria Guerra, counsel for appellant, file the appellate brief with this Court on or before 5:00 p.m. on February 12, 2024. If the Honorable Victoria Guerra fails to file the appellate brief with this Court on or before 5:00 p.m. on February 12, 2024, then the Honorable Victoria Guerra will be ordered to appear in person at a time and place to be determined, to show cause why she should not be held in contempt of court.
