ORDER OF DISMISSAL

Joseph W. Nega Judge.

This case is calendared for an in-person trial at the session of the Court scheduled to commence on October 17, 2022, in San Antonio, Texas.

On August 24, 2022, petitioner filed a Motion to Dismiss. In that motion, petitioner states that the liabilities for the taxable years at issue in this, have been previously determined pursuant to a decision entered by this Court on November 9, 2012. Furthermore, petitioner represents that respondent has no objections to the granting of petitioner's motion.

Upon due consideration and cause, it is

ORDERED that petitioner's Motion to Dismiss filed August 24, 2022, is granted and this case is dismissed.
