279 App. Div. 875 (N.Y. App. Div. 1952)

Opinion

February 25, 1952.

In an action for a separation, defendant appeals from two orders made on motions by plaintiff wife. The first order, made May 8, 1951, granted reargument, adhered to the original decision, and ordered appellant to pay alimony pendente lite and a counsel fee. The second order, dated August 2, 1951, adjudged appellant guilty of contempt for failure to make payments as prescribed by the former order, fined him in the amount of the arrears, with requirements for installment payments thereof, and awarded an additional counsel fee to plaintiff for the making of the second motion. Orders affirmed, with one bill of $10 costs and disbursements. No opinion. Nolan, P.J., Carswell, Wenzel, MacCrate and Schmidt, JJ., concur.
