Appellant's brief was originally due July 3, 2024. We granted appellant's first motion for extension of time, extending the deadline for filing the brief to August 2, 2024. On August 3, 2024, appellant filed a motion requesting an additional 30-day extension of time to file the brief. We granted the motion and ordered appellant to file his brief by September 3, 2024.
On September 5, 2024, appellant filed a third motion for extension of time. In his motion, appellant represented that he had recently discovered that four 9-1-1 calls, which were designated as State's Exhibits 3, 5, 7, and 9, had been published during the February 20, 2024 motion to suppress hearing but were neither transcribed into the record nor transmitted to this court as exhibits. Appellant requested an additional two-week extension of time to file his brief. He also asked this court to order the record supplemented with the missing exhibits.
After consideration, we ORDER the court reporter to prepare, certify, and file in this court a supplemental reporter's record containing State's Exhibits 3, 5, 7, and 9 from the February 20, 2024 motion to suppress hearing by September 19, 2024. Tex.R.App.P. 34.6(d). If State's Exhibits 3, 5, 7, and 9 have been lost or destroyed, we ORDER the court reporter to notify this court and the parties of that fact by September 19, 2024. We suspend appellant's briefing deadline until further order of this court.
