This case is currently calendared for trial at the Court's Houston, Texas trial session, scheduled to begin March 27, 2023.

On March 6, 2023, the Commissioner filed a motion to dismiss for lack of prosecution. The Court held a conference call with the parties on March 16, 2023. In light of the discussion, it is

ORDERED that the Commissioner's motion to dismiss for lack of prosecution is denied without prejudice. It is further

ORDERED that this case is stricken from the above-referenced trial session and jurisdiction is retained by the undersigned. It is further

ORDERED that, on or before April 17, 2023, the parties shall file a joint status report (or separate reports, if that is more expedient) apprising the Court of the then-present status of this case.
