Opinion

22774.

September 25, 2000.

Appeal from the Second Circuit Court.

MOON, C.J., LEVINSON, NAKAYAMA, RAMIL, and ACOBA, JJ.

AMENDED ORDER DISMISSING REPLY

Upon consideration of Petitioner-Appellant's reply to the order denying motion for reconsideration in which Appellant states that the "Notice of Certiorari" filed on August 21, 2000 was not a motion for reconsideration but a notice that Appellant wishes to seek further review; it appears that: (1) on June 28, 2000, the supreme court affirmed the circuit court order denying Appellant's motion to correct or reduce sentence; (2) on August 3, 2000, the supreme court issued a notice and judgment on appeal; and (3) after entry of the notice and judgment on appeal by the supreme court, the jurisdiction of the Hawaii appellate court ended, and this appeal is closed. Therefore,

IT IS HEREBY ORDERED that the reply to order denying motion for reconsideration is dismissed.
