Judgment reversed upon the law and the facts, and a new trial granted, costs to appellant to abide the event. There were facts presented which required the submission of the case to the jury. Young, Kapper, Hagarty, Scudder and Tompkins, JJ., concur. [ 134 Misc. 90.]
