Appellant having moved for permission to proceed as a poor person, for assignment of counsel on the appeal taken herein from an order of the Supreme Court entered in the Office of the Clerk of the County of Monroe on November 19, 2012, and for other relief,

Now, upon reading and filing the affidavit of Terlesa Cowart sworn to February 13, 2014, the notice of motion with proof of service thereof, and the affirmation of Jesslyn A. Holbrook, Esq., dated February 25, 2014, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is dismissed on the ground that the appeal was previously dismissed when it was not perfected on or before February 22, 2014, pursuant to the order of this Court entered January 22, 2014.
