Goldner v. Mencher

Appellate Division of the Supreme Court of New York, First Department
Nov 21, 1949
276 App. Div. 760 (N.Y. App. Div. 1949)

Opinion

November 21, 1949.

Present — Peck, P.J., Glennon, Callahan, Van Voorhis and Shientag, JJ.;

Order, so far as appealed from, affirmed, with $20 costs and disbursements. No opinion.

Shientag, J., dissents and votes to reverse, with leave to serve an amended complaint on the ground that, in its present form, the complaint is insufficient in law. A few general, conclusory statements are insufficient to form the basis of a charge of conspiracy to destroy the business of the plaintiffs without lawful justification. [See post, p. 893.]
