In Miller v. Kase, No. CP 96-4957 IY, 2001 WL 686909, at *1 (Fla. 4th DCA June 20, 2001), this court reversed a declaratory judgment and remanded for further proceedings. Consistent with that decision we reverse the circuit court's April 24, 2000 order which struck the probate claim of Carole Miller and vacated the agreed order entered January 28, 1998.
