Golden v. Delray Medical Center, Inc.

District Court of Appeal of Florida, Fourth District
Jun 7, 1988
524 So. 2d 1160 (Fla. Dist. Ct. App. 1988)

Opinion

No. 4-86-1928.

May 18, 1988. Rehearing Denied June 7, 1988.

Appeal from the Circuit Court for Palm Beach County; Richard I. Wennet, Judge.

Charles Wender of Smith, Smith Wender, P.A., Boca Raton, for appellants.

Phillip T. Crenshaw of Arnstein, Gluck, Lehr Milligan, West Palm Beach, for appellee-Dr. Norman Silversmith.

We are of the opinion that the trial court erred in denying appellants' claim against Norman Silversmith, M.D. We say this because the evidence reflects that there was a partnership between Norman Silversmith and Steven Silverstein so that each of them was responsible as a partner for the liabilities incurred under the purchase and sale contract with the seller, Central Medical Services, Inc. Moreover, it is clear that Dr. Silversmith later ratified the contract.

REVERSED.

HERSEY, C.J., and DELL, J., concur.

WALDEN, J., dissents without opinion.
