DECISION & ORDER ON MOTION

Motion by the petitioners/cross-respondents for leave to reargue a proceeding pursuant to CPLR article 78 to review stated portions of a determination of the Commissioner of the New York State Division of Human Rights, dated January 25, 2010, which was determined by decision and judgment of this Court dated June 28, 2011, or, in the alternative, for leave to appeal to the Court of Appeals from the decision and judgment of this Court. Separate motion by the respondent to direct the Clerk of the Court of Nassau County to enter judgment in the amounts specified in the decision and judgment dated June 28, 2011, or, in the alternative, to modify or amend the decision and judgment dated June 28, 2011, to direct the Clerk of the Court of Nassau County to enter judgment.

Upon the papers filed in support of the petitioners/cross-respondents' motion and the papers filed in opposition thereto, and upon the papers filed in support of the respondent's motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the petitioners/cross-respondents' motion is denied; and it is further,

ORDERED that the respondents' motion is denied without prejudice to seeking appropriate relief in the Supreme Court, Nassau County.
