In an action to vacate a judgment in favor of respondent Herman entered in the Municipal Court of the City of New York, Borough of Brooklyn, order granting motion to dismiss the complaint under rule 113 of the Rules of Civil Practice, and the judgment entered thereon, unanimously affirmed, with ten dollars costs and disbursements. No opinion.
