Goff v. Ehrlich

District Court of Appeal of Florida, Fifth District
Jan 19, 2001
776 So. 2d 1011 (Fla. Dist. Ct. App. 2001)

Summary

finding no private right of action under chapter 106

Summary of this case from Torres v. Shaw

Opinion

No. 5D00-1740.

Opinion filed January 19, 2001.

Appeal from the Circuit Court for Seminole County, Gene R. Stephenson, Judge.

Affirmed.

Michael D. Jones, of Leffler Associates, P.A., Winter Springs, for Appellant.

Ronald G. Meyer and Mary F. Aspros, of Meyer and Brooks, P.A., Tallahassee, for Appellees.

Goff was the successful candidate for the Seminole County School Board who, after the election, sued his opponent for allegedly violating the provisions of Chapter 106, Florida Statutes, by not reporting a supporter's payment of a pre-election and post-election legal challenge to Goff's qualifying residency as a contribution to the campaign. Because we find that Chapter 106 does not confer a private right of action, we affirm the trial court's dismissal of the complaint.

See Fischer v. Metcalf, 543 So.2d 785 (Fla. 3d DCA 1989).

THOMPSON, C.J., and PLEUS, J., Concur.
