Present — Ingraham, McLaughlin, Laughlin, Clarke and Scott, JJ.


Without passing upon the question as to whether or not the defendant is guilty of unfair competition in business such as would justify an injunction, as that question should be left to the trial of the action, we think the order appealed from should be affirmed, with ten dollars costs and disbursements.


Order affirmed, with ten dollars costs and disbursements.
