In Godbold v. Godbold, 13 S.C. 601 it was held that a creditor was not entitled to recover from the legatees the value of certain slaves left them by the decedent; but it appeared that the slaves had been emancipated before the creditor's suit was brought so that the creditor lost nothing by the distribution.
