ORDER


After making an independent review of the pleadings, files, and records in this case, and the January 26, 2001 findings, conclusions, and recommendation of the magistrate judge, the court concludes that the findings and conclusions are correct. It is therefore ordered that the findings, conclusions, and recommendation of the magistrate judge are adopted and the motion for summary judgment of defendant Victor Rodriguez is granted. It is further ordered that plaintiff's November 6, 2000 motion for relief pursuant to Rule 11 is denied.

SO ORDERED

JUDGMENT

For the reasons set out in orders filed February 1, 2000 and today, it is ordered and adjudged that plaintiff's action against defendant Victor Rodriguez("Rodriguez") is dismissed with prejudice.

Rodriguez's taxable costs of court, as calculated by the clerk of court, are assessed against plaintiff.

Pursuant to Fed.R.Civ.P. 54(b), the court expressly determines that there is no just reason for delay and directs the clerk of court to enter this as a final judgement.
