An appeal having been taken to this Court from an order of the Supreme Court, New York County, entered on or about October 07, 2022,
And defendant-appellant having moved for a stay of all proceedings, including enforcement of the directives in the aforesaid order requiring the parties to complete discovery on the issues of specific performance and compensatory damages and requiring plaintiff to file a note of issue, and enforcement of the status conference order dated November 10, 2022, pending hearing and determination of the appeal taken therefrom, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is granted on condition the appeal is perfected for the May 2023 Term of this Court.
