Keeshaun Xavier Glover, Appellant, v. State of Florida, Appellee.

Jessica J. Yeary, Public Defender, and Megan Long, Assistant Public Defender, Tallahassee, for Appellant. Ashley Moody, Attorney General, and Julian E. Markham, Assistant Attorney General, Tallahassee, for Appellee.

Not final until disposition of any timely and authorized motion under Fla. R. App. P. 9.330 or 9.331.

On appeal from the Circuit Court for Duval County. Kevin Blazs, Judge.

Jessica J. Yeary, Public Defender, and Megan Long, Assistant Public Defender, Tallahassee, for Appellant.

Ashley Moody, Attorney General, and Julian E. Markham, Assistant Attorney General, Tallahassee, for Appellee.

LONG, J.

Glover argues the trial court fundamentally erred by relying on his marital status in sentencing. However, our review of the record reveals that the trial court's comment about Glover's marital status was a recitation of the facts presented by Glover during his family-based mitigation argument. The record reflects that Glover's marital status was not improperly relied upon in sentencing.

AFFIRMED.

ROWE, C.J., and OSTERHAUS, J., concur.
