By Order dated June 2, 2021, this case was set on the calendar for the remote Trial Session of the Court at New York, New York, on November 1, 2021. On October 8, 2021, the parties submitted a proposed stipulated decision in this case. On October 18, 2021, the Court issued an Order to Show Cause why the Court should not issue an order directing the small tax designation to be removed from the case. On October 26, 2021, respondent filed a response stating no objection to the Order to Show Cause. When this case was called from the calendar on November 1, 2021, petitioner and respondent appeared and were heard. At that time, petitioner confirmed that she did not object to the Order to Show Cause.
Upon due consideration, and for cause more fully appearing in the transcript of the proceedings it is
ORDERED that the Court's Order to Show Cause, dated October 18, 2021, is made absolute. It is further
ORDERED that the docket number in this case is amended by deleting the letter "S" therefrom, and the Clerk of the Court is hereafter directed to process this case to trial or other disposition according to the regular procedure of the Court. It is further
ORDERED that the Proposed Stipulated Decision, submitted October 8, 2021, is hereby deemed stricken from the Court's record in this case. It is further
ORDERED that, on or before January 7, 2022, the parties shall file a decision document or status report informing the court of the then-present status of the case.
