ORDER MODIFYING OPINION AND DENYING PETITIONS FOR REHEARING

FYBEL, J.

It is ordered that the opinion filed herein on June 27, 2011, be modified as follows: On page 44, paragraph 1. of the Disposition is deleted and replaced with the following new paragraph 1:

1. That portion of the Amended Judgment awarding judgment in favor of Fleck Research and against Apex for breach of written contract, specifically: Amended Judgment, paragraph (1), page 3, line 6, the words “first (breach of written contract)”; those portions of the Amended Judgment awarding Global attorney fees (Amended Judgment, paragraph (8), page 4, lines 7 9);”

This modification does not effect a change in the judgment. The petitions for rehearing filed by (1) Frank Fischer, (2) Apex Equity Partners, Inc., and (3) Global Connector Research Group, Inc., are DENIED.
