Opinion

Civil Action No. 07J-08-181THG.

April 3, 2008.

Christine Paoli, Rehoboth Beach, DE.

Dean Campbell, Esquire, Law Office of Dean A. Campbell, LLC, Georgetown, DE.

Dear Ms. Paoli and Mr. Campbell:

The saga continues.

On August 11, 2003, judgment was entered in Justice of the Peace Court 19 in favor of William Glenn and against Christine Paoli in the amount of $1,261.75 with interest from that date.

Since then, Ms. Paoli and Mr. Glenn have had running legal battles from JP Court to the Court of Common Pleas to Superior Court.

In August 2007, the judgment was filed in Superior Court and in October 2007, Mr. Glenn sought the sale of a mobile home owned by Ms. Paoli in order to satisfy the judgment.

The sale date was January 16, 2008. Ms. Paoli knew of the sale. She did not bid on the mobile home.

Pursuant to her Motion to Vacate the Sale filed January 28, 2008, she argued that on the date of the sale, she tried to pay off the judgment at the Sheriff's Office but they would not take her money.

On February 15, 2008, the Motion was argued. I gave Ms. Paoli the opportunity to rewind the film and to pay off the judgment, just as if it was the date of the sale. I gave her until March 7, 2008 to come up with her money and to also provide proof she had made arrangements to remove the mobile home from Mr. Glenn's property.

She agreed, but when she learned that she would be responsible for interest from the date of the judgment, she said, "Oh, keep the mobile home" and stormed out of the Courtroom. Her Motion was then denied.

Now she seeks to have the Court reconsider the decision of February 15, 2008 and to nullify the January 16, 2008 sale.

I shall not revisit the ruling made on February 15, 2008. It seems that Ms. Paoli enjoys the litigation with Mr. Glenn and is willing to do anything to keep the litigation alive.

On February 15, 2008, Ms. Paoli argued her position and I was prepared to conditionally grant her relief. But Ms. Paoli abandoned her Motion and therefore, there is nothing to revisit.

Ms. Paoli's Motion to Reconsider is denied.

IT IS SO ORDERED.
