         Pursuant to 28 U.S.C. § 636, the Court has reviewed the Petition, all the records and files herein, and the magistrate judge's report and recommendation. The Court accepts the recommendations of the magistrate judge.

         ACCORDINGLY, IT IS ORDERED:

         1. The report and recommendation is accepted.

         2. Judgment shall be entered consistent with this order.

         3. The clerk shall serve this order and the judgment on all counsel or parties of record.

         JUDGMENT

         Pursuant to the order accepting the magistrate judge's report and recommendation, IT IS ADJUDGED that the petition in this matter is denied and dismissed with prejudice.
