Opinion
November 29, 1955.
The complaint in this action combines several suggested causes of action without any clear delineation of the causes of action intended to be stated or the basis of claimed liability against the several defendants. For example, one might glean from the complaint causes of action based on fraud, trust, malicious interference with a business, breach of contract and unfair competition. Which of one or more of these causes of action is intended to be stated should be clearly and separately set forth and the basis for each such cause of action stated as to each defendant. Order unanimously reversed, with $20 costs and disbursements to the appellants, and the motion granted requiring the plaintiff to serve an amended complaint complying with the directions of the memorandum opinion above.
