Supreme Court of Texas
Mar 15, 1950
148 Tex. 604 (Tex. 1950)

Opinion

No. A-2478.

Decided March 15, 1950.

Writ of Error — Immaterial Questions — Appeal and Error.

Where an application for writ of error presents only questions not necessarily controlling the disposition of the case, it will be dismissed for want of jurisdiction.

Application for writ of error to the Court of Civil Appeals for the Sixth District, in an appeal from Smith County.

Pollard, Lawrence and Reeves and W. Dewey Lawrence, all of Tyler, for petitioner.

Troy Smith and Ted Chilcote, both of Tyler, for respondent.

Application for writ of error is dismissed for want of jurisdiction. Since the points presented by the application for writ of error involved only questions of the admissibility of evidence, which do not necessarily control the case, the application for writ of error is dismissed for want of jurisdiction.
