Gillis v. State

District Court of Appeal of Florida, Third District
Nov 21, 2008
993 So. 2d 573 (Fla. Dist. Ct. App. 2008)

Opinion

No. 3D07-2577.

October 22, 2008. Rehearing Denied November 21, 2008.

A case of original jurisdiction — Habeas Corpus.

Ranier Gillis, in proper person.

Bill McCollum, Attorney General, and Rolando A. Soler, Assistant Attorney General, for respondent.

Before GERSTEN, C.J., CORTINAS, J., and SCHWARTZ, Senior Judge.

Upon the State's confession of error, with which we agree, we grant the defendant's petition in part, and reverse and remand for the trial court to vacate the defendant's judgment and sentence on counts 13, 15, and 19. We find no merit, however, in the remaining points raised in defendant's petition, and in all other respects affirm the judgment below.

Petition granted in part, and denied in part, and cause remanded with instructions.
