FORMER ADJUDICATION, § 28unappealed final orders dismissing suit in equity. Unappealed final orders dismissing suit in equity at plaintiff's costs and denying plaintiff's subsequent motion to set aside order of dismissal and for leave to file a third amended complaint at law were "res judicata" and constituted a complete defense to plaintiff's subsequent action at law against the same defendants and for the same causes of action.

Appeal from the Circuit Court of Hancock county; the Hon. RILEY STEVENS, Judge, presiding.

Affirmed. Heard in this court at the February term, 1949.
