ORDER

Patrick J. Urda, Judge

This case is currently calendared for trial during the Court's San Diego, California remote trial session, which is scheduled to begin September 20, 2021. On September 16, 2021, respondent filed a status report stating that a basis for settlement has been reached. He also requested additional time to submit a fully executed stipulated decision.

Upon due consideration, it is

ORDERED that respondent's motion to dismiss for lack of prosecution filed August 11, 2021, is denied as moot. It is further

ORDERED that Ms. Giller's motion to withdraw or modify the deemed admitted admissions pursuant to Rule 90(f) filed August 25, 2021, is denied as moot. It is further

ORDERED that Ms. Giller's motion under RFCP Rule 36(b) to withdraw or amend a handful of automatic admissions, filed September 3, 2021, is denied as moot. It is further

ORDERED that this case is stricken from the above referenced trial session, and the parties are excused from appearing at the calendar call on September 20, 2021. It is further

ORDERED that jurisdiction of this case is retained by the undersigned. It is further

ORDERED that, on or before November 5, 2021, the parties shall electronically submit a stipulated decision or file a joint status report.
