This case is calendared for trial at the Trial Session of the Court scheduled to commence on March 21, 2022, for cases where Indianapolis, Indiana is the place of Trial.

On January 18, 2022, respondent (the Internal Revenue Service or "IRS") filed with the Court a Motion for Summary Judgment, and a Declaration of William Rowe in Support of Motion for Summary Judgment. By Order dated February 3, 2022, the Court directed Petitioners to file a response to respondent's Motion for Summary Judgment by March 3, 2022. On February 16, 2022, the parties in this case submitted a Proposed Decision Document for the Court's consideration.

After due consideration, and for cause, it is

ORDERED that this case is stricken for trial from the March 21, 2022, Indianapolis, Indiana trial calendar. It is further

ORDERED that respondent's Motion for Summary Judgment, filed on January 18, 2022, is denied as moot.
