BEFORE: KUHN, HIGGINBOTHAM, AND THERIOT, JJ.

WRIT GRANTED. The district court's judgment of September 16, 2013, denying relator, Winn-Dixie Montgomery, LLC's motion for summary judgment is hereby reversed and judgment is entered in favor of relator, granting its motion and dismissing Nellie Gilbert's claims with prejudice. Relator met its burden on its motion for summary judgment and respondent failed to produce factual support sufficient to establish that she would be able to satisfy her evidentiary burden of proof at trial.
