DECISION & ORDER ON MOTION

Motion by respondents on an appeal from a decision of the Civil Court of the City of New York, Queens County, dated December 12, 2014, to vacate a stay granted by decision and order on motion of this court dated July 13, 2015, for the release of funds on deposit, and for an award of costs and fees.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the branch of the motion seeking to vacate the stay contained in the decision and order on motion of this court dated July 13, 2015 is granted; and it is further,

ORDERED that the branch of the motion seeking the release of funds on deposit is granted and the funds on deposit in this matter shall be released to respondent MHA Realty, less any lawful fees; and it is further,

ORDERED that the remainder of the motion is denied.
