STIPULATION AND ORDER OF DISMISSAL WITHOUT PREJUDICE * CLERK'S ACTION REQUIRED


STIPULATION

COME NOW the Plaintiff, Nancy Giger, by and through their attorney of record, Thomas P. Sughrua, and the Defendant, Sea-Mar Community Health Center, by and through their attorney of record, Robert Taylor, and hereby agree to the dismissal of their respective claims against one another in the above-entitled cause of action, with all claims, counterclaims, cross-claims, whether actually asserted or capable of being asserted, without prejudice, for the purpose of allowing the plaintiff to exhaust her administrative remedies, and with each of the said parties bearing its own costs and fees.

ORDER

THIS MATTER having come on duly and regularly this day before the undersigned judge of the above-entitled court, upon presentation of a Stipulation and Order of Dismissal Without Prejudice, and the court having reviewed the files and records herein, and being otherwise fully advised of the premises, NOW, THEREFORE, it is hereby,

ORDERED, ADJUDGED AND DECREED that the parties above stipulation is hereby entered as an order of court, and further it is hereby ordered that Plaintiff's claims against defendant are hereby dismissed, without prejudice, for the purpose of allowing plaintiff to exhaust her administrative remedies, and without costs or fees to any of the said parties.

THE CLERK OF THE COURT IS HEREBY DIRECTED to enter this order dismissing the claims of the plaintiff against against the defendant, without prejudice and with each of the said parties bearing its own costs and fees.
