Gibson v. State

District Court of Appeal of Florida, Fourth District
Sep 20, 2000
767 So. 2d 623 (Fla. Dist. Ct. App. 2000)

Opinion

Case No. 4D99-1147

Opinion filed September 20, 2000 July Term 2000

Appeal from the Circuit Court for the Seventeenth Judicial Circuit, Broward County; Paul L. Backman, Judge; L.T. Case No. 98-9994CF10B.

Richard L. Rosenbaum of the Law Offices of Richard L. Rosenbaum, Fort Lauderdale, for appellant.

Robert A. Butterworth, Attorney General, Tallahassee, and Robert R. Wheeler, Assistant Attorney General, West Palm Beach, for appellee.

The Defendant appeals his conviction for robbery and his fifteen-year sentence as a prison releasee reoffender. The Defendant raises four points on appeal. With regard to the Defendant's argument that Pompano Beach police officers lacked authority to arrest him outside their jurisdiction because the officers were not in fresh pursuit, we disagree and affirm the trial court's denial of the Defendant's motion to suppress. See Porter v. State, No. 4D99-1425, 2000 WL 1189961 (Fla. 4th DCA Aug. 23, 2000). The Defendant's remaining arguments are without merit. Accordingly, we affirm the Defendant's conviction and sentence.

AFFIRMED.

WARNER, C.J., GUNTHER and STEVENSON, JJ., concur.
