DECISION AND ORDER ON MOTION

Motion for permission to appeal and for further relief.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion for permission to appeal and for further relief is treated as a motion, pursuant to CPLR 5704 (a), to review an order of Supreme Court, Suffolk County, dated December 18, 2020, which, among other things, granted a temporary restraining order, and it is further

ORDERED that the motion is granted, without costs, only to the extent that pending determination by Supreme Court, Suffolk County of the motion returnable before that court on December 29, 2020, the temporary restraining order issued in the order to show cause signed December 18, 2020 is vacated.
