Gerton v. Brown

Appellate Division of the Supreme Court of New York, Second Department
Oct 1, 1923
207 App. Div. 826 (N.Y. App. Div. 1923)

Opinion

October, 1923.

Orders reversed on the law, with ten dollars costs and disbursements, and plaintiff's motion for judgment on the pleadings denied, with ten dollars costs. We think the answers of the defendants presented issues which require a trial upon the merits. Kelly, P.J., Rich, Manning, Kelby and Young, JJ., concur.
