This case is calendared for hearing at the New York, New York, trial session of the Court scheduled to commence on September 18, 2023.

On September 11, 2023, the Commissioner filed a supplement to Motion to Dismiss for Lack of Jurisdiction previously filed on September 12, 2022, attaching a copy of the notice of deficiency (notice) and a copy of the postmarked envelope containing the notice.

Upon due consideration, and for cause, it is

ORDERED that, on or before 5 pm (ET) on Friday, September 15, 2023, Ms. Gersten shall file a Reply to the Commissioner's Response to Ms. Gersten's Objection, filed July 26, 2023, and a Response to the Commissioner's First Supplement to Motion to Dismiss for Lack of Jurisdiction, filed September 11, 2023.
