Gerst v. Gerst

Appellate Division of the Supreme Court of New York, Second Department
Mar 1, 1930
228 App. Div. 833 (N.Y. App. Div. 1930)

Opinion

March, 1930.

Order reversed upon the law and the facts, without costs, and motion granted, without costs, to the extent of allowing $150 for counsel fee; one-half thereof to be paid within five days from service of a copy of the order herein, and the balance at the opening of trial. We think the motion should have been granted to this extent. A prompt trial will secure the plaintiff alimony if her claim is meritorious. Lazansky, P.J., Young, Carswell, Scudder and Tompkins, JJ., concur.
