ORDER


Based upon the Joint Stipulation submitted by the parties in the above-entitled matter, and for good cause appearing, the Court ORDERS that:

1. After the outcome of dispositive motions and prior to trial, Defendant will be permitted to name its expert witnesses, file expert reports, conduct Rule 35 exams, depose Plaintiff's expert(s), and conduct one or more depositions of third-party witnesses. After the outcome of dispositive motions and prior to trial, Plaintiff will be permitted to depose Defendant's experts.

2. The dispositive motion cutoff is moved to November 19, 2004.

3. Final supplementations under Rule 26(e) are due sixty (60) days before trial.

4. The trial date of January 25, 2005 is vacated;

5. If the matter survives summary judgment, the parties will request a scheduling conference with the magistrate to schedule a trial date.
