266 So. 2d 368 (Fla. Dist. Ct. App. 1972)

Opinion

No. 71-358.

August 21, 1972.

Appeal from Circuit Court, St. Lucie County; C. Pfeiffer Trowbridge, Judge.

Julius Earl German, in pro. per.

Robert L. Shevin, Atty. Gen., Tallahassee, and Andrew I. Friedrich, Asst. Atty. Gen., West Palm Beach, for appellee.

We have reviewed the briefs and record on appeal, and on the basis thereof we are of the opinion that no reversible error has been demonstrated.

The judgment appealed from is, therefore, affirmed.

CROSS and MAGER, JJ., concur.

REED, C.J., dissents, with opinion.

I would reverse for an evidentiary hearing to determine whether or not the appellant's situation requires a new trial on the same principle as was applied in Costello v. State, Fla. 1972, 260 So.2d 198.
