John W. Germaine Petitioner v. Commissioner of Internal Revenue Respondent

ORDER

ALINA I. MARSHALL JUDGE

On September 3, 2021, petitioner filed a motion for continuance, citing medical issues as the basis for any continuance. Petitioner's motion for continuance is an inappropriate document to file with the Court at this time, since this case remains uncalendared for a remote trial.

On September 10, 2021, respondent filed a status report. On September 16, 2021, the Court scheduled a conference call on September 30, 2021, with the parties. On September 21, 2021, petitioner contacted a representative of the Court and requested that any matter moving this case forward be postponed due to petitioner's ongoing health issues.

Accordingly, it is

ORDERED that petitioner's motion for continuance filed September 3, 2021, is denied as moot. It is further

ORDERED that the conference call scheduled to commence on September 30, 2021, is hereby canceled. It is further

ORDERED that, on or before December 20, 2021, the parties shall file a joint status report reflecting the then present status of this case. In that report, the parties shall state whether the parties would be available, shall the Court calendar this case for remote trial at the session of the Court scheduled to commence on either February 14 or March 14, 2022.
