On May 14, 2021, petitioner filed with the Court a Motion for Summary Judgment; and on July 6, 2021, a Supplement to Motion for Summary Judgment, and on August 13, 2021, respondent filed with the Court a Response to Motion for Summary Judgment.

The Court set petitioner's Motion for Summary Judgment, filed May 14, 2021, as supplemented July 6, 2021, for remote hearing at calendar call on September 13, 2021, at 10:00 AM (ET) (with New York, New York being listed as the location for the hearing for administrative purposes only).

This case was called from the calendar for hearing at the Court's remote New York, New York trial session on September 13, 2021. There was no appearance by or on behalf of petitioner. Respondent appeared and indicated to the Court that the parties had reached a basis for settlement.

After due consideration, and for cause more fully appearing in the transcript of the proceeding, it is

OREDERED that petitioner's Motion for Summary Judgment, filed May 14, 2021, as supplemented July 6, 2021, is denied without prejudice to refile. It is further

ORDERED that, on or before October 15, 2021, the parties shall submit decision documents or file either separate or joint status reports with the Court as to the then present status of this case.
