WILLIAM ALEXANDER GEORGE, APPELLANT v. VELMA SKIEF, APPELLEE

APPEAL FROM THE 7TH

JUDICIAL DISTRICT COURT

SMITH COUNTY, TEXAS

MEMORANDUM OPINION

PER CURIAM

This appeal is being dismissed for want of prosecution. See TEX. R. APP. P. 42.3(b). Appellant, William Alexander George, perfected his appeal on November 4, 2010. Due to a remand for further action by the trial court, Appellant's brief was not due until January 20, 2012. On February 2, 2012, Appellant was notified that neither his brief nor a motion for extension of time had been filed with the court. Appellant was further notified that the appeal could be dismissed for want of prosecution under Texas Rule of Appellate Procedure 42.3(b) unless a motion for extension of time was filed no later than February 13, 2012. Further, the notice informed Appellant that the motion for extension of time must contain a reasonable explanation for his failure to file the brief and a showing that Appellee, Velma Skief, had not suffered material injury thereby.

To date, Appellant has neither complied with, nor otherwise responded to, this court's February 2, 2012 notice. Accordingly, we dismiss the appeal for want of prosecution. See TEX. R. APP. P. 38.8(a)(1), 42.3.(b). Panel consisted of Worthen, C.J., Griffith, J., and Hoyle, J.
