DECISION & ORDER ON MOTION

Motion by respondent to dismiss an appeal from a judgment of the District Court of Suffolk County, Fourth District, entered December 4, 2013, for lack of prosecution and to vacate a stay granted by decision and order on motion of this court dated April 25, 2014.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the motion is granted, the appeal is dismissed and the stay is vacated.
