ORDER


This cause comes before the Court on Defendant PTI's Motion for Award of Costs and Attorney's Fees (Doc. No. 81) filed FEBRUARY 7, 2001.

The United States Magistrate Judge has submitted a report recommending that PTI's Motion for Award of Costs and Attorney's Fees be denied.

After an independent de novo review of the record in this matter, including Plaintiff's Response to Plastic Tubing Industries' Motion for Award of Costs and Attorney's Fees (Doc. No. 82, filed February 22, 2001); Defendant PTI's Objections to Report and Recommendations (Doc. No. 84, filed June 27, 2001); and Plaintiff's Response to PTI's Objection to Report and Recommendations (Doc. No. 85, filed July 11, 2001), the Court agrees entirely with the findings of fact and conclusions of law in the Report and Recommendation. Therefore, it is ORDERED as follows:

1. That the Report and Recommendation filed JUNE 20, 2000 (Doc. No. 83) is ADOPTED and CONFIRMED and made a part of this Order.

2. Defendant PTI's Motion for Award of Costs and Attorney's Fees (Doc. No. 81) is denied.

DONE and ORDERED.
