Gelman Sciences, Inc. v. Fidelity and Casualty Co.

Supreme Court of Michigan
Mar 12, 1997
560 N.W.2d 638 (Mich. 1997)

Opinion

No. 105981.

March 12, 1997.

Leave to Appeal Granted March 12, 1997:

The issue is limited to whether the lower courts erroneously applied the date of manifestation of injury as the appropriate trigger of coverage for determination of insurance carrier responsibility to the insured. The joint motion of Cello-Foil Products, Inc., Gelman Sciences, Inc., Arco Industries Corporation, and Frederick C. Matthaei, Jr., for consolidation is treated as a motion for joint submission and it is granted. This case is to be argued and submitted with Cello-Foil Products, Inc v. Michigan Mutual Liability Co, No. 104107, and Arco Industries Corp v. American Motorists Ins Co, No. 106678. Leave to file briefs amici curiae is also granted. Reported below: 214 Mich. App. 560.
