ORDER TO SHOW CAUSE

This case is currently calendared for trial at the Session of the Court commencing on November 18, 2024, in Philadelphia, Pennsylvania. On September 27, 2024, respondent filed a Motion to Dismiss for Failure to Properly Prosecute. Therein, respondent states that on September 9, 2024, he sent a Branerton letter to petitioner, scheduling a telephone conference for September 16, 2024, to discuss this case; however, petitioner did not attend the telephone conference. Respondent also states that on September 16, 2024, after petitioner did not attend the telephone conference, he called petitioner at the telephone number provided on the Petition; however, the telephone number was no longer in service. Respondent further states that on September 17, 2024, he sent a second Branerton letter to petitioner, scheduling a telephone conference for September 24, 2024, to discuss this case, and for a second time, petitioner did not attend the scheduled telephone conference. According to respondent, on September 24, 2024, he again attempted to contact petitioner at the telephone number provided on the Petition; however, the telephone number was still out of service. Finally, respondent states that he has been unable to contact petitioner relative to whether there is any objection to the granting of his motion. It would be helpful for the Court to hear from petitioner regarding respondent's motion and the status of this case. Upon due consideration, it is hereby

ORDERED that petitioner shall contact the chambers of the undersigned Judge at (202) 521-0822 as soon as possible for the purpose of scheduling a conference call to discuss respondent's Motion to Dismiss for Failure to Properly Prosecute and the status of this case. It is further

ORDERED that petitioner shall show cause in writing, on or before October 28, 2024, why this case should not be dismissed for failure to properly prosecute.
