Motion by respondent to dismiss as untimely an appeal from an order of the Civil Court of the City of New York, Richmond County, entered December 29, 2014.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied as moot, as the appeal from the order of the Civil Court entered December 29, 2014 was previously dismissed by decision and order on motion of this court dated April 22, 2015 under appeal No. 2015-649 RI C.
