2014 N.Y. Slip Op. 68488 (N.Y. App. Div. 2014)

Opinion

Motion No: 517786

04-03-2014

In the Matter of CARL GEE, Appellant, v. RICHARD DESIMONE, as Associate Counsel in Charge of Office of Sentence Review, Respondent.

DECISION AND ORDER ON MOTION

Motion for permission to proceed as a poor person, for assignment of counsel and for extension of time to perfect appeal.

Upon the papers filed in support of the motion, and no papers having been filed in opposition thereto, it is

ORDERED that the motion for permission to proceed as a poor person and for assignment of counsel is denied, without costs, on the ground that the motion papers fail to set forth sufficient facts so that the merit of the contentions underlying the appeal can be ascertained, as required by CPLR 1101 (a), and it is further

ORDERED that the motion for an extension of time to perfect the appeal is granted, without costs, and the time is extended to June 2, 2014.

Lahtinen, J.P., Stein, Rose and Egan Jr., JJ., concur.
